ORDER : The Court made the following order :- The petitioner /accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 105 and 238(a) of BNS in Crime.No.253 of 2024, seeks anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent Police and the learned counsel for the intervenor.
3. Considering the nature of allegation in this case that the petitioner herein and other accused had set up live wire fencing in the land belonging to the first accused and the de facto complainant's husband came into contact with the live wire and died and thereafter, all the accused clandestinely removed the body and threw into the adjacent well. This is not a fit case for grant of anticipatory bail as custodial interrogation for unearthing the truth is very much essential in the instant case.
4. The matter of live wire fencing is the subject matter in the coordinate bench of this court in which I am also a party. Repeatedly a stand has been taken by the officials that they are conducting joint patrolling and that there are no live wire fencing. Repeated cases before this court show otherwise. Therefore, let a copy of this order be placed before the District Collector concerned. In spite of the framing of the rules by the Government to erect solar fencing, the same is not being 2/4
undertaken by any of the farmer. It seems that the erecting of live wire fencing is rampant in the entire District. Repeatedly information is furnished before the Division Bench as if joint patrolling is undertaken and as if there are no live wire fencing at all. Therefore, a copy of this order shall also be placed before the Forest authorities as well as the District Superintendent of police and the District Collector so that the appropriate action should be taken. The copy of this order is also be marked to the Chairman, TANGEDCO for appropriate action. The matter should also be brought to the notice of the Government, that there has been repeated loss of lives of both man and also animal.
