For Respondent : Mr.S.MANIKANDAN, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 288 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 427, 395, 397 and 506(ii) IPC, in Crime No.288 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 14.06.2021, the accused persons had went to the shop of the defacto complainant and robbed a sum of Rs.5,000/- (Rupees five thousand only) with knife point and damaged showcase worth about Rs.25,000/- (Rupees twenty five thousand only) and also criminally intimidated the employees of the shop with knife. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and not committed any offence as alleged by the prosecution. He would further submit that in this case two accused persons had been arrested and remanded to judicial custody and other accused were already released on bail. 4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner is having three previous cases at his credit.

CRL OP(MD). No.19450 of 2021 5.Reading of the First Information Report clearly shows the involvement of the petitioner in the alleged occurrence. Considering the damages caused by the petitioner, the role played by the petitioner in the above said occurrence and also the bad antecedents of the petitioner, this Court is not inclined to enlarge the petitioner on bail.
