To prefer this memorandum of civil miscellaneous appeal against the order passed by the learned Sessions Judge dismissing the application in Cr.M.P.No.3705 of 2009 in Criminal Original Petitioner No.1 of 2009 dated 20.01.2011. ORDER : This civil miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.ARJUN VARMAN, Advocate for M/S.LAJAPATHI ROY AND ASSOCIAT, Advocate for the petitioner and of M/s.M.AASHA, Government Advocate on behalf of the Respondent, the Court made the following order:- This Petition is filed to condone the delay of 515 days in filing the Appeal. 1/3

2. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to allow this petition on payment of cost.

3. This petition is allowed on condition that the petitioner shall pay the cost of Rs.1,000/- (Rupees Thousand only) to the Mediation and Conciliation Centre attached to this Bench, within a period of Four weeks from the date of receipt of a copy of this order.

4. M/s.M.Aasha, the Learned Government Advocate, takes notice for the respondent.
