O R D E R
This Criminal Original Petition has been filed seeking to quash the final report in Spl.S.C.No.77 of 2023 on the file of the III Additional District Court for PCR Cases, Madurai, filed against the petitioners for the offences punishable under Sections 294(b), 323, 324, 427 and 506(2) of the Indian Penal Code, 1860, Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002, and Sections 3(1)(r), 3(1)(s) and 3(2) (va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

The allegation in the final report is that, on account of previous enmity, the petitioners attacked the defacto complainant and her mother with stones, sticks and cricket stumps, abused them in filthy language, humiliated them on account of their caste, and demolished an asbestos sheet house worth about Rs.5,000/-, and thus committed the aforesaid offences.

3. Admittedly, the petitioners and the second respondent belong to the same village. It is reported that the victim died. The parties have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 28th November 2024. The scanned copy of the compromise memo reads as follows:

4. The petitioners, namely, (1) V.Rajangam, (2) Andichamy, and (3) V.Thiyagarajan and the second respondent/defacto complainant, namely, C.Vallimayil are present before this Court in person. The parties are identified by Mr.B.Kabir Oli, Special Sub Inspector of Police, Kottampatti Police Station Madurai District. It is also confirmed by the learned Government Advocate (Criminal Side) for the first respondent that the second respondent/defacto complainant has not received compensation in terms of the Act. All the parties confirmed the compromise arrived at between them.
5. In view of the same and considering the nature of the offences and the relationship between the parties, this Court is of the view that no Page No. 5 of 8
useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in Spl.S.C.No.77 of 2023 on the file of the III Additional District Court for PCR Cases, Madurai, is quashed. The petitioners shall pay a sum of Rs.5,000/- as costs to the Mediation and Conciliation Centre attached to the Madurai Bench of Madras High Court forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
