[Order of the Court was made by R.SUBRAMANIAN, J.] Mr.P.Thilak Kumar, learned Government Pleader takes notice for the respondents. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
2.The prayer in the Writ Petition reads as follows:- "To issue a Writ of Mandamus, directing the respondent no.2 to consider and act upon the representation dated 15.07.2024 and make appropriate entries in the revenue and village records reflecting the existence of the Kizhavan Temple in Survey No.90, Samusigapuram Village, Rajapalayam Taluk, Virudhunagar District and recognize that it is maintained and administered by the Yadavar community."
3.A perusal of the revenue records particularly the A register of Samusigapuram Village, shows that the existence of temple is in Survey No.90 is noted thereat. The petitioner wants a declaration that it belongs to Yadava community. Such declaration either can be granted by this Court or by the revenue authorities.
4.Hence, this Writ Petition is dismissed. This will not however, preclude the petitioner from approaching the authorities under the Tamil Nadu Hindu Religious and Charitable Endowment Act, 1959, to seek a declaration in this regard. No costs.
