ORDER

The petitioner, who is residing and working in USA, is having properties in his native place and also in Chennai. In order to manage the properties, he appears to have executed a power of attorney in favour of one Rufus Deepak. Now, the petitioner, by making certain allegations as against the power agent, has lodged a complaint before the respondent Police. The petitioner's complaint has been registered in Crime No.32 of 2025 on the file of the 3rd respondent for the offences under Sections 406, 420, 296(b) and 351(2) IPC. Now, the petitioner, with a grievance that the respondent Police has not conducted the investigation in a fair manner, has filed this petition seeking a direction to the 1st respondent to transfer the investigaitn in Crime No.32 of 2025 from the file of the 3rd respondent to the 2nd respondent.

2. The learned Additional Public Prosecutor submits that the case has been registered on 22.01.2025 and they have examined seven witnesses so far and they may conclude the investigation within a period of two weeks. 2/4

3. Since the respondent Police claims that the investigation is almost completed, this Court is not inclined to entertain this petition by transfering the investigation from the file of the 3rd respondent to the 2nd respondent.

4. However, the 3rd respondent Police has to conduct the investigation in a fair manner by considering the grounds raised by the petitioner in this petition and to file the final report in accordance with law. The Deputy Superintendent of Police, Usilampatti, is directed to monitor the investigation.
