ORDER

The writ petition is filed seeking a direction to the second respondent to conclude the proceedings in Pa.Ve.A3/18/2020 dated 06.08.2020.

2.Heard the arguments of Mr.J.Vishnu, learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate appearing for the respondents. Since no adverse order is passed against the third respondent, notice to the third respondent is dispensed with.

3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4.According to the petitioner, the property situated in Survey No. 408/1 Ilandharaikondan Village, Rajapalayam Taluk, Virudhunagar District, is his ancestral property. However, the patta for the subject property wrongly issued in the name of the third respondent. Hence, the petitioner submitted a representation on 29.10.2020. Pursuant to the

same, the second respondent issued a memo in Proceeding No.Pa.Ve.A3/18/2020, dated 06.08.2020. Thereafter, there is no progress in the matter. Hence, the petitioner has come before this Court. 5.The learned Government Advocate appearing for the respondents 1 and 2 would submit that if the petitioner submits all the relevant documents, his representation will be considered in accordance with law. 6.The petitioner virtually seeks cancellation of patta issued in the name of third respondent. Therefore, the first responder is the competent authority to consider the request of the petitioner as per Section 12 of the Tamil Nadu Patta Passbook Act. Accordingly, the second respondent is directed to forward the representation of the petitioner dated 29.10.

2020 to the first respondent within a period of two weeks from the date of receipt of a copy of this order. The first respondent shall consider the representation of the petitioner and pass final orders on its own merits, within a further period of twelve weeks, after affording reasonable opportunity to the petitioner and the third respondent.

7.With the above direction, this Writ Petition is disposed of. No costs.
