PRAYER in W.P.(MD).No.17514 of 2018: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to disburse petitioner's salary for the period from the year 1999 to 1/3

For Petitioners : Mr.Kannan for M/s.Veera Associates For Respondents : Mr.A.K.Manikkam Special Government Pleader C O M M O N O R D E R The petitioner in W.P.(MD).No.17513 of 2018 has sought a Mandamus directing the respondents to disburse her husband's salary for the period 1999 to 29.11.2001, when he was relived from service, along with arrears and all benefits with interest at 18% per annum.
2. Though Mr.A.K.Manikkam, learned Special Government Pleader appearing for the respondents states that he has filed counters, no counters are available on file. Let the Registry put the same up along with cost memo in the Court bundle.
3. Be that as it may, both the learned counsel would concur upon the position that the Society ie., R4, Tiruchirapalli District Co-operative Agro Socieity Limited is under liquidation.
4. The respondents would state that it is only after assets of the Society are disposed that there would be adequate liquidity to meet liabilities, including the claims of the petitioner. Thus, and in such circumstances, it would suffice that a direction be issued to the respondents to take action, upon the representation of the petitioners for settlement of pending claims after hearing them, as expeditiously as possible, preferably within a period of three months from today.
5. In W.P.(MD).No.17514 of 2021, a similar request has been made by an employee, who claims that she has not received salary from 1999. This petitioner was relieved by the respondent Society on 29.11.2001. He would also state that a claim has been filed by her before R4, the Liquidation Officer. The contents of, and direction at paragraph 4 of this order are reiterated in this case as well. These Writ Petitions are closed as above. No costs.
