PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned notice vide C.No.01/ECI/TUT/2023, dated 10.08.2023, issued by the third respondent and quash the same as illegal and consequently direct the second respondent to grant appropriate prior permission for conducting the Kabaddi match, which is scheduled to be held on 02.09.20223 and 03.09.2023 in Mangottapuram, Thoothukudi District.

O R D E R
This Writ Petition is filed under Article 226 of the Constitution of India, by way of Mandamus, seeking for a direction to the respondent Police Nos.1 and 2 Police to grant permission for playing of Kabaddi Tournament from 02.09.2023 to 03.09.2023 at Mangottapuram, Thoothukudi District, by setting aside the orders passed by the respondent Police, dated 10.08.2023 vide proceedings in C.No.01/ECI/TUT/2023.

It is submitted by learned counsel for the petitioner that every year, the villagers belonging to the petitioner would conduct Kabaddi Programme in the month of September without any whatsoever wherein the players from the School and Colleges will be asked to participate and this year, the organizers have decided to conduct the kabaddi matches as on 02.09.2023 and 03.09.2023 and in respect of that, the representation is given to the third respondent Police on 09.08.2023, however, the same was rejected by the respondent Police by the impugned order, dated 10.08.2023 vide proceedings in C.No.01/ECI/TUT/2023, thereby, sought for suitable directions to the respondent Police.
3. Learned Government Advocate (Criminal Side) has submitted that the permission sought for by the Police was rejected as there are strong 2/4
objections from the same Community to which the petitioner belonging to and the petitioner has been collecting the funds and donations from the people of other community It is also submitted that a Peace Committee Meeting was conducted under the aegis of the Tahsildar, but, consensus could not be arrived at as rival party has arisen serious objections and thereby permission is declined and that if permission is granted, it may lead to law and problem.

The petitioner, who intended to conduct the Kabaddi Tournament with 60 to 70 teams has not submitted any blueprint to the respondent Police in respect of the details of number of teams participating, play grounds, accommodation to the players, toilets, food, refreshment to be provided to the players and more particularly, medical facilities including ambulance.
5. In view of the above, this Court is not inclined to pass directions to the respondent Police to give permission for playing the Kabadi.

Accordingly, the Writ Petition is disposed of, however, the petitioner is at liberty to submit fresh application along with the details referred above and on filing of such application, in case, if there is no law and order problem, the respondent Police are directed to consider the same.
