O R D E R
The Writ Petition is filed seeking a direction to the respondents 1 and 2 to conduct an enquiry and rectify the error in UDR relating to the property in S.No.297/3 at Puthanatham Village, Manapparai Taluk, Trichy District by considering the Petitioner's representation, dated 5.6.2025.
2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 and 2 and Mr.K.Jeyamohan, learned counsel takes notice for the third respondent.. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, the property in subject survey number is a natham property and the same is in possession and enjoyment of the Petitioner's family and the Petitioner's father executed a settlement deed on 19.12.2002 settling the subject property in favour of the Petitioner. During UDR up-dation, the 2/6
name of one Puthunatham Jumma Mosque was entered in the revenue records. Therefore the Petitioner submitted a representation on 5.6.2025 before the second respondent seeking rectification of UDR records and the said representation has not considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.Mr.A.Baskaran, learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that representation submitted by the petitioner will be considered on its own merits within the time stipulated by this Court. 5.The learned counsel for the third respondent would submit that the second respondent may be directed to afford reasonable opportunity to the third respondent before passing the final order.
6.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the representation submitted by the Petitioner on 5.6.2025 and pass final orders on its own merits after affording reasonable opportunity to the Petitioner, third respondent, Puthunatham Jumma Mosque and other interested parties, if any within a period of 12 weeks from the date of a copy of this order. 3/6
7.With the above directions, the Writ Petition stands disposed of. No costs.
