COMMON PRAYER :- For Bail in Crime No.392 of 2025 on the file of the Respondent police. COMMON ORDER : The Court made the following order :- The petitioners / Accused Nos.1, 2 & 3, who were arrested and remanded to judicial custody on 19.07.2025, 19.07.2025 and 28.07.2025 respectively for the offences punishable under Sections 191(3), 126(2), 296(b), 118(1) and 109 BNS, 2023 in Crime No.392 of 2025 on the file of the respondent police, seek bail.
2. The case of the prosecution is that due to previous enmity, on 18.07.2025, the petitioners and the other accused had attacked the son of the defacto complainant by using sword, hands and legs and abused him in filthy language. Hence, the case.
3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offences as alleged by the prosecution and that a false case has been lodged as against the petitioners. He would further submit that the petitioners are ready and willing to abide any conditions that may be imposed by this Court and that the petitioners are in custody from 19.07.2025, 19.07.2025 and 28.07.2025 respectively nearly 23, 23 and 14 days. Hence, he seeks bail.

The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that there are totally 5 accused, the petitioners arrayed as A1 to A3, that due to previous enmity, the petitioners and the other accused attacked the defacto complainant's son and that the injured was admitted in the hospital on 18.07.2025 and was discharged on 26.07.2025. He would further submit that the injured sustained grievous injuries and that the first accused is having one previous case and the third accused is having two previous cases and the second accused is not having any previous cases. However, he objected to grant bail to the petitioners.

Taking into consideration of the facts and circumstances of the case and considering the fact that the injured was discharged from the hospital and also the fact that by this time, most of the investigation might have been completed and taking note of the fact that the petitioners remanded into judicial custody on 19.07.2025, 19.07.2025 and 28.07.2025 respectively, taking into consideration of the period of incarceration, this court is inclined to grant bail to the petitioners, subject to the following conditions:
6. Accordingly, the petitioners are ordered to be released on bail on executing 3/6
a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate No.1, Sivagangai, Sivagangai District and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] The petitioners shall furnish their residential address and contact number to the Judicial Magistrate No.1, Sivagangai, Sivagangai District. If the petitioners change their residential address, they shall report the same to the Judicial Magistrate No.1, Sivagangai, Sivagangai District;
[c] the petitioners shall stay at Dindigul and appear and sign before the Inspector of Police, Dindigul Taluk Police Station, Dindigul daily two times at 10.00 a.m. and 05.00 p.m., until further orders;
[d] the petitioners shall not abscond either during investigation or trial; [e] the petitioners shall not tamper with evidence or witness either during investigation or trial;
[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail 4/6
by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; and [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
