ORDER
This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, the learned Central Government Standing Counsel for the first respondent and the learned Government Advocate (Crl.Side) for the second respondent.
2. The petitioner has filed a passport application on 10.07.2025 vide passport application No. TR1075315857025.

The petitioner has thereafter received a communication from the office of the first respondent, dated 18.07.2025, wherein the petitioner has been called upon to explain regarding the adverse report received in respect of the FIR registered in Crime No.44/2020 for the offences under Sections 294(b), 324, 341 and 506(2) IPC.

4. The learned counsel for the petitioner submits that the petitioner has also filed an application before the Judicial Magistrate Court, Urathanadu in Crime No.44 of 2020. However, it has been returned stating that no charge sheet has been filed.

The learned Government Advocate (Crl.Side) for the second respondent, on the other hand, submits that the charge sheet has been filed on 01.06.2024 before the Judicial Magistrate Court, Urathanadu vide e-filing No.LTN20220001530C2025000477. However, he submits that the same has not been taken on file.
6. Since the charge sheet has not been taken on file, there can be no impediment to direct the first respondent to process the aforesaid passport application of the petitioner. Accordingly, there shall be a direction to the first respondent to process the passport application in File No. TR1075315857025 dated 10.07.2025 of the petitioner within six (6) weeks from the date of receipt of a copy of this order.

It is made clear that in case the charge sheet is taken on file and the case is numbered before the Judicial Magistrate Court, Urathanadu before whom the charge sheet has been filed electronically, the petitioner shall, on his own volition, come forward to surrender the same and thereafter, file a suitable application to retrieve the same before traveling abroad.
