PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents to permit the petitioner to join as Special Teacher (IEDSS) under the 4th respondent school on the basis of petitioner's representation, dated 03.09.2024.

ORDER

The instant Writ Petition has been filed by a teacher, appointed under SSA scheme, seeking a mandamus, directing the fourth respondent to permit the petitioner to join as a special teacher on the basis of his representation, dated 03.09.2024.

2. According to the petitioner, he applied for medical leave for one month from 01.07.2024 to 31.07.2024. Thereafter, since he was not able to attend the school due to personal inconvenience, another request was made by the petitioner for medical leave from 01.08.2024 to 18.08.2024. When the petitioner reached the school on 19.08.2024 to join duty, the fourth

respondent refused to permit him to join duty. Hence, the present writ petition.

3. The learned Additional Government Pleader, on instructions, submits that the petitioner, being a scheme employee under SSA, is not eligible for any medical leave. However, when the petitioner approached the school on 19.08.2024, he was not prevented from attending to duty. Therefore, according to the learned Additional Government Pleader, the petitioner can very well join duty.

4. Considering the above said facts, the fourth respondent is directed to permit the petitioner to join duty in case the petitioner joins duty from 01.10.2024 onwards.

5. With the above observation, this Writ Petition stands disposed of. No costs. Consequently, the connected W.M.P.(MD) No.18993 of 2024 is closed.
