PRAYER: Sub Application is filed under Section 151 of the C.P.C. reopen the contempt petition filed in Cont.P(MD)No.464 of 2025 dated 23.04.2025. PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, 1971, to punish the contemnor/respondent for willfully disobeying and not complying with the order passed by this Court in WP(MD)No.12759 of 2018 dated 17.10.2024.

ORDER

The present Sub Application has been filed seeking to reopen the contempt proceedings that were closed on 23.04.2025 relying upon a communication by the District Educational Officer, Tenkasi, to Chief Educational officer on 22.04.2025.

2. A perusal of the order passed in W.P(MD)No.12759 of 2018 dated 17.10.2024 reveals that this Court has issued a direction to the authorities to permit conversion of Pre-vocational Post from Weaving Instructor into that of Sewing Mistress and allow the petitioner school to fill up the said post.

3. A perusal of the communication dated 22.04.2025 reveals that this is only a recommendation of the District Educational Officer, Tenkasi to the Chief Educational Officer, Tenkasi. So far, the Chief Educational Officer has not passed any orders.

4. In view of the above said facts, the Sub Application stands allowed. The contempt petition in Cont.P(MD)No.464 of 2025 is restored.

5. Post the contempt petition on 07.01.2026.
