ORDER
The petitioner has challenged the impugned communication issued by the respondent, dated 05.07.2025 bearing reference in Letter No.Nkngh/tpkpgt/tpUJ/cnrngh/nghJ/cngh-1/Nfh.
HT SC No.273 / m.vz; : 1074 / 25.
2. By the impugned communication, the petitioner's request dated 07.06.2025 for an additional load of 75 KVA has been rejected.
3. The reason stated in the impugned order is that the petitioner must make an application under the Deposit Contribution Works (DCW) Scheme.
4. The learned Standing Counsel for the respondent submits that the original HT service connection was granted to the petitioner as early as 2008, and subsequently, the load was also increased at the petitioner's request. However, the petitioner has now completely compounded the land, resulting in difficulty in maintaining the HT lines that run over the petitioner's premises.
5. It is further submitted that, at best, the petitioner may file an application under the aforementioned Scheme and request for shifting of the HT line, in which case the petitioner's request for enhancement of load will also be considered.
6. The learned counsel for the petitioner, on the other hand, submits that the petitioner's land is surrounded by patta land, and therefore, individuals may raise objections. He further submits that the petitioner is willing to permit entry to the Officers of the Electricity Board and will not impede any maintenance activities.
7. Considering the above said submissions, the impugned order is set aside, and the matter is remitted back to the respondent to pass an appropriate sanction
order enhancing the power load of the petitioner. It is made clear that the petitioner shall co-operate with the respondent and permit access whenever required for the maintenance of the HT line.
8. The Writ Petition stands disposed of with the above observations. No costs.
