Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the 2nd respondent to issue patta to the petitioner for the land in S.No.382/4 in Renganayakkanpatti Village, Nilakottai Taluk, Dindigul District, by implementing his order, in Na.Ka.No.260/2023/A4 dated 19.05.2023, within a time to be fixed by this Court.

ORDER

The present writ petition has been filed for a mandamus to the 2nd respondent to issue patta to the petitioner for the land in S.No.382/4 in Renganayakkanpatti Village, Nilakottai Taluk, Dindigul District, by implementing his order, in Na.Ka.No.260/2023/A4 dated 19.05.2023.

2. The petitioner was assigned the lands comprised in Survey No. 382/4 Renganayakkanpatti Village and patta no.2559 was issued to her. The petitioner has been in occupation and enjoyment of the said land. While so, in the year 2023, when she was checking for her online chitta, she found that her patta has been changed as patta no.4278 and the name of one Chinnammal w/o Veran was shown. Immediately, she had made a representation to the 2nd respondent on 28.03.2023 calling upon her to cancel the illegal patta and restore it to her name. After enquiry, the 2nd respondent found that the name has been updated without following proceeding. Therefore, the 2nd respondent had ordered to cancel the same and directed that the patta be reissued in the name of the petitioner. Despite the same, the 2nd respondent has failed to issue the patta. Though

there is no appeal against the said order, no further action has been taken on the side of the respondents. Therefore, the petitioner is before this Court.

Taking note of the fact that the 2nd respondent himself has cancelled the patta issued to the said Chinnammal and directed to reissue patta in the name of the petitioner by his order, dated 19.05.2023, a mandamus is issued to the 2nd respondent to issue patta to the petitioner in respect of S.No.382/4 in Renganayakkanpatti Village, Nilakottai Taluk, Dindigul District. The said exercise shall be completed within a period of six (6) weeks from the date of receipt of copy of this order.

4. With the above directions, this Writ Petition stands allowed. No costs.
