Criminal Original Petition filed under section 482 of Criminal Procedure Code, to set aside the order made in Crl.M.P.No.2824 of 2019 by the the Principal Sessions Judge, Ramnad dated 16.09.2019 and direct the Judicial Magistrate No.I, Thoothukudi to permit the petitioner comply with the condition No.1 imposed in Crl.M.P.No.2478 of 2019 by the Principal Sessions Judge, Ramnad dated 14.08.2019 For Petitioner :

O R D E R

This Criminal Original petition has been filed to set aside the order made in Crl.M.P.No.2824 of 2019 by the the Principal Sessions Judge, Ramnad dated 16.09.2019 and direct the Judicial Magistrate No.I, Thoothukudi to permit the petitioner comply with the condition No.1 imposed in Crl.M.P.No.2478 of 2019 by the Principal Sessions Judge, Ramnad dated 14.08.2019.

2. The petitioner was arrested and remanded to judicial custody on 11.07.2019 in Crime No.145 of 2019 on the file of the respondent. Subsequently he was released on bail on condition that the petitioner shall stay at Tuticorin and report and sign before the learned Judicial Magistrate No.I, Tuticorin daily at 10.00 a.m until further orders. Accordingly the petitioner complied the condition for two days on 20.08.2019 and 21.08.2019 and on 22.08.2019 he went to the Court and he did not hear properly when his name was called by the Court. Hence he could not appear before the Court. Thereafter he filed application to condone his absence and the same was rejected. Therefore he has filed the present petition.

3. Considering the above facts and circumstances of the case, the absence of the petitioner on 22.08.2019 before the learned Judicial Magistrate No.I, Tuticorin is condonded and the https://hcservices.ecourts.gov.in/hcservices/

petitioner is directed to comply with the conditions as imposed by the learned Principal District and Sessions Judge, Ramanathapuram in Crl.M.P No.2478 of 2019 on 14.08.2019. Further the petitioner is directed to comply with the conditions imposed by the trail court without fail.

4. With the above direction, the Criminal Original Petition is disposed of.
