Prayer in WP(MD)No.1253 of 2020:- Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Directing the Respondent No.1 to complete the disciplinary proceedings, initiated vide the Charge Memo in Letter No.16702/20133/A4, dated 15-06-2016, on the file of the Respondent No.1 within the time stipulated by this Honourable Court. ORDER:- This Writ Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.N.Satheesh Kumar, Government Advocate for the Petitioner and of Mr.S.Louis,Advocate for the 1st Respondent, this Court made the following order:- The Assistant Director of Town Panchayat filed the Miscellaneous Petition seeking extension of time to complete the departmental disciplinary proceedings.
2.The learned Additional Government Pleader appearing on behalf of the petitioner states that due to COVID-19, the authorities were https://hcservices.ecourts.gov.in/hcservices/ 1/2
WMP(MD). No.18930 of 2021 not in a position to complete the disciplinary proceedings as per the time fixed by this Court. Further the allegation against the respondent employee is relating to corruption charges and examination of witnesses are also involved. Therefore, they need some more time for the parties to complete the enquiry. 3.Considering that the allegations of corruption are involved against the respondent employee and further, considering the pandemic situation, which was prevailing during the relevant point of time, when this Court fixed time, the petition is to be considered. Accordingly, the authorities are directed to continue the disciplinary proceedings by avoiding unnecessary adjournments and conclude the same within a period of four months from the date of receipt of a copy of this order. The respondent employee is directed to cooperate for the early disposal of the disciplinary proceedings.
