ORDER : The Court made the following order :- The petitioners/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 109, 462, 477A of IPC likely to be altered to
Sections 109, 462 and 477 of IPC, in Crime No.241 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner has misappropriated a sum of Rs.1,36,00,000/- belongs to 11 illiterate employees who are working as a part-time cleaning staff of the panchayat. The petitioner has also alleged to tear the PFMS and expenditure slips in the office and he kept some of the panchayat council documents in his car in order to steal them and he had taken photograph of the parish documents sent them as PDF to the Vice President Pandiarajan. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.
4. Heard the learned Additional Public Prosecutor.
5. A reading of the CD file shows that a complaint was given against the petitioner. Thereafter, he was released on bail by the respondent. A summon dated 26.08.2023 was issued to the petitioner for his appearance before the respondent police on 28.08.2023. But without responding to the notice, the petitioner has approached this Court for the relief of anticipatory bail. The petitioner was already released on bail by the respondent and hence there is no question of granting of anticipatory bail by this Court.
