For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.321 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 454 and 380 of IPC in Crime No.321 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that on 19.09.2022, some unknown persons were trespassed into the house of the defacto complainant and robbed 13 1⁄2 sovereigns of gold jewels worth about Rs.4,05,000/-. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner and the defacto complainant are relatives. Based on the confession statement of the co-accused, the petitioner has been implicated in this case. He would further submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he may be granted anticipatory bail by this Court.

CRL OP(MD). No.18169 of 2022 4.The learned Government Advocate (Crl.side) appearing for the respondent police would submit that the property has not been recovered so far. The first accused was arrested and the other accused are still absconding. He would further submit that investigation in this case is at the initial stage and the custodial interrogation of the petitioner is very much necessary. Hence, he strongly opposed for grant of anticipatory bail to the petitioner. 5.Considering the facts and circumstances of the case and also considering the facts that property has not been recovered and the investigation in this case is at the initial stage and custodial interrogation of the petitioner is very much necessary as stated by the learned Government Advocate(Crl.side), this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 12/10/2022 / TRUE COPY / /10/2022 Sub-Assistant Registrar (C.S.)
