ORDER : The Court made the following order :- The petitioners/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 420 of IPC in Crime No.not known of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 20.05.2023, at about 8.30 p.m., the defacto complainant made a complaint alleging that the petitioner who is a General Manager in the defacto complainant's company, has misappropriated a sum of Rs.27,35,040/-. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case.

4. Learned Additional Public Prosecutor would submit that only petition enquiry is pending on the basis of the complaint given by one Narayanan/ defacto complainant against the petitioner as if he has misappropriated an amount of Rs.27.35 Lakhs.

5. Perusal of the CD file shows that the petitioner has appeared before the respondent and undertook to settle the issue. According to the petitioner, the said statement was obtained by force. A blank cheque also stated to be issued in favour of the defacto complainant to the police. Reading of the statement does not indicate the issuance of blank cheque in favour of the defacto complainant.

6. Let the petitioner appear before the respondent and co-operate with the process of enquiry. The respondent is directed to complete the enquiry within a period of 15 days. If any trouble arises during the course of enquiry, the petitioner is at liberty to workout remedy through appropriate proceedings.

7. With this direction and liberty, this Criminal Original Petition stands disposed of.
