PRAYER :-For Bail in Crime No.473 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused No.4, who was arrested and remanded to judicial custody on 16.11.2021 for the offence punishable under Sections 286, 337 of IPC and Section 9(B) (1) (a) of the Indian Explosives Act, 1884, altered into Sections 286, 337, 304(ii) of IPC r/w Section 9(B)(1)(a) of the Indian Explosives Act, 1884, in Crime No.473 of 2021, on the file of respondent police, seeks bail. 2.The case of the prosecution is that on 15.11.2021, at about 02.30 p.m, without having any proper license, manufacturing the fire crackers in the residential house, there was an explosion and the persons, who were working under the accused No.1 & 2 sustained injuries. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution, he has been falsely implicated in this case. CRL OP(MD). No.19519 of 2021 custody from 16.11.2021 and he would further submit that the petitioner is only the supplier of explosive substance. Hence, he seeks bail to the petitioner.

4.Considering the limited role alleged against the petitioner and also considering the antecedents of the petitioner that there is no previous case in similar nature against the petitioner and the petitioner is in judicial custody from 16.11.2021, this Court is inclined to grant bail to the petitioner subject to the following conditions:

5.Accordingly, the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Sivakasi, Virudhunagar, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
