ORDER
The Writ Petition has been filed seeking a Writ of Certiorarified Mandamus, to call for the entire records in relating to the impugned rejection order dated 10.09.2024 of the respondent and to quash the same and consequently, to direct the respondent to grant appropriate permission and adequate police protection to the petitioner to conduct the Day-Night Kabadi Tournament on 20.09.2024, 21.09.2024 & 22.09.2024 in the ground, viz; Narayanapuram Kadukkan Madasamy Thidal, in Nagan Pudhu Colony, Srivaikundam.
2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.It is not in dispute that the respondent has already passed an order dated 10.09.2024 rejecting the petitioner's request. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that one section of the village people have 2/6
already conducted Kabadi tournament, in pursuance to the directions of this Court issued vide order in W.P.(MD)No.20027 of 2024 dated 21.08.2024.
5.At this juncture, the learned counsel appearing for the petitioner would submit that they are neighboring village people and they have no connection whatsoever with the people, who conducted the tournament earlier and that they are ready to conduct the tournament from 10.00 a.m. to 10.00 p.m. for three days i.e., 20.09.2024, 21.09.2024 & 22.09.2024 6.I have considered the submission of the learned counsel appearing for the writ petitioner and the learned Additional Public Prosecutor appearing for the respondents.
7.It is brought to the notice of this Court that the Director General of Police, Tamil Nadu, Chennai had issued a circular memorandum in Rc.007301/Genl.I (1)/2019 dated 09.04.2019 along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of applications seeking permission for conducting programme. Therefore, in 3/6
view of the detailed circular and guidelines issued by the Director General of Police, the writ petitioner is directed to file afresh representation incorporating the date and time of the Kabadi tournament before the respondent and on such representation, the respondent is directed to consider the same and pass orders by taking note of the points now raised by the learned Additional Public Prosecutor, on or before 20.09.2024.
8. With the above directions, this Writ Petition stands disposed of. No costs.
