PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 4 and 5 herein to initiate fresh acquisition in respect of in S.No.572/3B to an extent of 2 acres lying in Kodalvavi Village, Vedasanthur Taluk, Dindigul District and pay the compensation to the petitioner as per fresh acquisition for the four way/six way project notification of Ministry of Rural Development, dated S.O.425(E), 09.02.2016.

ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the and respondents 4 and 5 to initiate fresh acquisition proceedings in respect of the petitioner's land in S.No.572/3B, measuring 2 acres, situated at Kodalvavi Village, Vedasanthur Taluk, Dindigul District, and to pay compensation to the petitioner as per such fresh acquisition in accordance with the Four-Way/Six-Way Project Notification of the Ministry of Rural Development, S.O.425(E), dated 09.02.2016, within a time frame to be stipulated by this Court.

2. The learned Additional Government Pleader appearing for the respondents 1 to 3 and 5 submits that 50% of the compensation amount has already been disbursed to the petitioner and that the remaining 50%, quantified at Rs.7,69,890/-, is yet to be paid. The said amount could not be paid on account of appeals pending before the competent Court. The learned Additional Government Pleader undertakes that the said amount shall be paid within a period of twelve weeks along with the applicable rate of interest. The said submission is placed on record.

3. In view of the aforesaid submission, the fifth respondent or the appropriate authority is directed to pay the balance 50% of the compensation amount, along with the applicable rate of interest, to the petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
