PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, to punish the Contemnors/Respondents for willfully disobeying and not complying with the order passed by this Court in W.P(MD)No.13309 of 2022, dated 27.06.2022.

ORDER

This is a petition seeking initiation of contempt proceedings against the Respondents for alleged violation of the order, dated 27.06.2022 passed by the Writ Court in W.P.(MD)No.13309 of 2022.

Heard Mr.G.Marichamy, learned counsel appearing for the Petitioner, Mr.K.Ramaiah, learned Standing Counsel, who accepts notice on behalf of the 1st Respondent and Mr.S.C.Herold Singh, learned Standing Counsel, who accepts notice on behalf of the 2nd Respondent. Therefore, no further notice is required to be issued to the Respondents. 2/7

The Contempt Petition has been filed for non compliance of the judgment and order passed by the Writ Court in W.P.(MD)No.13309 of 2022 dated 27.06.2022 and the learned Single Judge of the Writ Court disposed of the said Writ Petition in the following terms: "4. In the light of the above observations, there shall be a direction to the first respondent herein to consider the petitioner's representation dated 04.10.2021 on its own merits and pass appropriate orders in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any of its views with regard to the merits of the claim of the petitioner and that it is open to the concerned respondent to consider the same on its own merits.

5. With the above direction, the Writ Petition stands disposed of. No costs."

4. Today, when the matter was taken up, Mr.K.Ramaiah, learned Standing Counsel, on behalf of the 1st Respondent and Mr.S.C.Herold Singh, learned Standing Counsel, on behalf of the 2nd Respondent, produced an order dated 12.08.2025 passed by the Tamil Nadu State 3/7

Transport Corporation (Madurai) Limited and submits that the representation submitted by the Petitioner was considered by the Respondents in accordance with law. Thus, they submits that the Respondents had complied with the judgment and order of the Writ Court in W.P.(MD) No.13309 of 2022, dated 27.06.2022. A copy of the said order has been taken on record and the same has been furnished to the learned counsel for the Petitioner. Therefore, the learned Standing Counsel prays that the Respondents may be discharged from the contempt proceedings and the contempt petition may be disposed of accordingly.

Mr.G.Marichamy, learned counsel for the Petitioner, received a copy of the order dated 12.08.2025 passed by the Tamil Nadu State Transport Corporation (Madurai) Limited and submits that the Respondent has decided the Petitioner's claim, albeit rejecting it. He further submits that if the Petitioner is aggrieved by the said order, he may be permitted to challenge it before the competent Court of law. The learned counsel states that he has no objection to the Respondent being discharged from the contempt proceedings.

After considering the submissions made by the learned counsel for the Petitioner and the learned Standing Counsel for the Respondents, and upon perusal of the order dated 12.08.2025 passed by the Tamil Nadu State Transport Corporation (Madurai) Limited, this Court is satisfied that the Respondents have fully complied with the judgment and order of the Writ Court dated 27.06.2022 passed in W.P.(MD)No.13309 of 2022. In view of the same, this Court deems it appropriate that no useful purpose would be served by keeping the contempt proceedings pending. Therefore, the Respondents are discharged from the contempt proceedings.

7. In view of the above, the Contempt Petition is disposed of with liberty to the Petitioner to challenge the order dated 12.08.2025 before the competent Court of law, if he is so aggrieved.
