ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ of Mandamus has been instituted to direct the second respondent/Bar Council of Tamil Nadu and Puducherry to process forthwith the Enrolment Application of the petitioner in Application No.PR/2024/36764 dated 25.10.2024.
2.The petitioner states that he perused undergraduate studies in Mechanical Engineering at Vins Christian College from the year 2006 to 2010. Thereafter, he completed Postgraduate Degree in M.Tech Aeronautical 2/7
Engineering from Hindustan Institute of Technology and Science in 2014. He subsequently pursued and completed a Doctorate in Aeronautical Engineering in the year 2021. The petitioner has chosen to pursue law and enrolled in a three-year LLB course at Lloyd Law College, Greater Noida in 2021 and completed the Law Degree in 2024. He submitted an application before the Bar Council of Tamil Nadu and Puducherry for enrollment. The application since not considered, the present Writ Petition came to be instituted.
3.The learned standing counsel appearing for the second respondent/the Bar Council of Tamil Nadu and Puducherry submitted that certificate verification is in process. The Bar Council of Tamil Nadu and Puducherry has already sent a letter to the Lloyd Law College, Greater Noida for issuance of genuinity certificate and on receipt of such genuinity certificate from the said College, further action will be initiated to consider the application submitted by the petitioner seeking for enrollment. 3/7
4.The learned counsel appearing for the petitioner submitted that there is a delay in obtaining the genuinity certificate and the Bar Council cannot be held responsible for such delay happening at the end of the College in which the petitioner undergone three-year Law course. 5.Pertinently, the petitioner has not impleaded the University, in which he has undergone the Law course.
6.The petitioner is at liberty to approach the College in which he studied and made a request to the Registrar of that University to respond to the letter sent by the Bar Council of Tamil Nadu and Puducherry. Contrarily, he cannot approach the High Court and seek a direction to enroll him as an Advocate in the State Roll without completion of certificate verification. Such a prayer in the absence of verification of certificate cannot be done. The Bar Council is bound to follow the procedures scrupulously in order to protect the integrity of legal profession and to ascertain the genuineness of the degrees obtained by the candidates submitting applications. 4/7
7.In view of the above, the petitioner is at liberty to comply with all the requirements as contemplated and thereafter, the Bar Council of Tamil Nadu and Puducherry may consider the application submitted by the petitioner for enrollment.
8.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
