Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorari, to call for the records pertaining to the impugned order dated 27.06.2025 passed by the 4th respondent vide proceedings No.Na.Ka.No.4986/2023/A1 and quash the same as illegal.

ORDER

This writ petition is filed challenging the order passed by the fourth respondent rejecting the application submitted by the petitioner seeking cancellation of patta issued in the name of the private respondents in respect of the properties situated in S.No.54/1 and 54/2 in Anupanadi Village, Avaniyapuram Firka, Madurai South Taluk.

2. Heard the arguments of Mr.C.Senthil Murugan, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 to 4. Since no

adverse order is passed against the respondents 5 & 6, notice to the respondents 5 & 6 is dispensed with.

3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

Against the impugned order passed by the Thasildar rejecting the application of the petitioner, he has got a remedy of appeal before the Revenue Divisional Officer under Section 12 of the Patta Passbook Act. Against the order passed by the Appellate Authority, the petitioner has got the remedy of revision before the District Revenue Officer under Section 13 of the Patta Passbook Act.

5. A perusal of the impugned order would indicate the petitioner effectively participated in the enquiry before the fourth respondent and therefore, there is no violation of the principles of natural justice to enable the petitioner to approach this Court by-passing the statutory remedies. In view of the availability of effective remedies before the hierarchy of the authorities under the Patta Passbook Act, this Court is

not inclined to entertain this writ petition and hence, the same is dismissed with liberty to the petitioner to work out the statutory remedy. No Costs. Consequently, the connected miscellaneous petition is closed. 14.08.2025 NCC : Yes/No Index : Yes/No Internet : Yes/No PJL To
