JUDGMENT
This Criminal Appeal has been preferred challenging the order dated 04.08.2025 made in Crl.M.P.No.186 of 2025 on the file of the learned III Additional District and Sessions Judge (PCR), Madurai.
2. The appellant is the sole accused in Crime No.375 of 2025 and the said case has been registered for the offences under Sections 296(b), 103(1) of BNS, 2023 and Section 3(2)(v) and 3(1)(s) of SC/ST (POA) Amendment Act, 1989.
3. The appellant has filed a bail application before the trial court during the pendency of trial and the same was dismissed. Aggrieved over that, this appeal has been preferred.
4. The learned counsel for the appellant submitted that the appellant has been falsely implicated in this case and he is under judicial custody from 20.04.2025 onwards.
5. The learned Government Advocate (Crl.side) submitted that the appellant has involved in several previous cases and he is a history sheeter rowdy. He further submitted that the appellant has been detained vide order dated 16.08.2025 made in No.33/BBCDEFGISSSV/2025, passed by the Commissioner of Police, Madurai City, holding him to be a "Goonda", as contemplated under Section of 2(f) of the Tamil Nadu Act 14 of 1982. A copy of the deter order dated 16.08.2025 has also been produced before this Court.
6. In view of the submission made by the learned Government Advocate (crl.side), there is no possibility to release the appellant on bail.
