ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This Writ Petition is filed to direct the respondents 1 to 3 herein to secure and produce the body or person of the petitioner's daughter S.Saranya, aged 19 years, D/o K.Shanmugam before this Court and set him at liberty. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2 . 3.The case of the petitioner is that the petitioner is working as an agricultural coolie and that his daughter Saranya aged about 19 years, is studying second year at SRM Nursing college in Kumabakonam and that she had gone to the college on 30.07.2025 at 11.00 a.m. But, she did not return back home. She had also left her cellphone in the house. Thereby, he was unable to trace her. On 31.07.2025, the petitioner along with his wife had given a complaint to the third 2/6
respondent Police to find out the whereabouts of the missing girl. The third respondent had issued C.S.R.No.606 of 2025 on 05.08.2025. Since the third respondent had not taken any further action, the petitioner has approached this Court by way of filing this habeas corpus petition. 4.The learned counsel appearing for the petitioner would submit that based on the complaint given by the petitioner, the third respondent has not conducted any proper investigation. Till date, the third respondent has not taken any steps to find out the whereabouts of the petitioner's daughter. Thereby, the present habeas corpus petition.
5.The learned Additional Public Prosecutor appearing for the respondents would submit that based on the complaint given by the petitioner, initially an enquiry was conducted in C.S.R.No.606 of 2025 and later, a case in Crime No. 266 of 2025 has been registered by the respondent Police under the caption of 'Women missing'. He would further submit that during the course of the investigation, it came to light that the petitioner's daughter had left with one Logeshwaran, who is also a resident of the same village. Based on the complaint 3/6
given by the mother of the said Logeshwaran, a case in Crime No.255 of 2025 was registered by the third respondent. He would further submit that the third respondent is taking steps to find out the whereabouts of the missing persons. He would further submit that as and when they are traced, they will be produced before the concerned Judicial Magistrate.
6.Taking into consideration the facts and circumstances of the case and the submission made by the learned Additional Public Prosecutor, the respondent is directed to continue the investigation to find out the whereabouts of the missing persons. If they are traced, they shall be produced before the concerned Judicial Magistrate by the third respondent Police. 7.Recording the same, this Habeas Corpus Petition is closed.
