ORDER : The Court made the following order :- The petitioners/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 427 of IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, 1992, in Crime No.256 of 2023, on the 1/3
file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on the basis of the complaint given by the defacto complainant, stating that some unknown persons caused damage to his vehicle bearing registration number TN 65 AV 2961, the present case came to be registered.
3. Learned counsel for the petitioners would submit that the petitioners and the defacto complainant do not belong to the same area. They are no way involved in the occurrence.
4. It is also submitted by the respondent that only for the purpose of enquiry the petitioners were called orally and no written summon was issued to the petitioners.
5. The learned Additional Public Prosecutor would submit that the petitioners are having previous cases for the offences of assault and under the provisions of NDPS Act.
6. The petitioners are directed to appear before the respondent police, if proper summons has been issued to them. During the course of investigation, if any trouble arises, the petitioners are at liberty to workout remedy through appropriate proceedings. If custodial interrogation of the petitioners are required, the respondent is at liberty to approach the concerned Court for appropriate orders. 2/3
