Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to put up construction of new bus shelter at Kuttakadai bus stop, Karur District, where the old bus shelter was demoslished for the welfare of the General public of Kuttakadai and other nearby Villagers and further direction to the fourth respondent to trace out the culprits who have demolished the bus shelter at Kuttakadai Bus Stop, Karur District based on the representation dated 28.08.2024.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ of mandamus has been instituted to direct the respondents to put up construction of new bus shelter at Kuttakadai bus stop, Karur District. 2/6

2. The construction of bus shelter is an administrative decision to be taken by the competent authorities. The existing bus shelter was demolished by some miscreants and no criminal case has been registered despite the complaint given by the President of Panchayat stating that the bus shelter was illegally demolished by some unknown persons. The police authority during the relevant point of time committed lapse dereliction of duty by not registering an FIR based on the complaint given by the President of Panchayat. Thus, this Court directed the Superintendent of Police, Karur District to conduct an enquiry and file a report.

The Superintendent of Police, Karur District in his status report has stated that the show cause notice was issued to the Sub-Inspector of Police Tmt.Subashini regarding lapses in investigation, vide C.No. 130/S.P/Camp/Karur/2025, dated 13.08.2025, under Rule 3(a) of the Tamil Nadu Police Subordinate Service (Discipline and Appeal) Rules, 1955. By initiating disciplinary proceedings against the Sub-Inspector of Police, FIR has also been registered in Cr.No.213 of 2025 by the Velayuthampalayam Police Station and the investigation has commenced. The Inspector is the Investigating Officer. The case registered must be proceeded with by following the procedures in accordance with 3/6

law. Regarding construction of bus shelter, the Block Development Officer may take an administrative decision in the interest of the public and construct in a place which may be suitable for construction of bus shelter. Construction of new bus shelter for the benefit of the public to be completed by the Block Development Officer, within a period of six months from the date of receipt of a copy of this order.
