PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records pertaining to the FIR pending in Cr.No. 41 of 2022 on the file of the Inspector of Police, CSCID, Madurai Police Station, Virudhunagar District and to quash the same as illegal against the Petitioner.

This Criminal Original Petition is filed to quash the FIR in Cr.No.41 of 2022 on the file of the Inspector of Police, CSCID, Madurai Police Station, Virudhunagar District, as against the Petitioner.

2.Heard Mr.R.Babu Jeganath, learned Counsel for the Petitioner and Mr.B.Nambi Selvan, learned Additional Public Prosecutor for the first Respondent.

3.The learned Counsel for the Petitioner submitted that the Petitioner had filed this Petition to quash the FIR in Cr.No.41 of 2022 pending on the file of the first Respondent. The learned Counsel for the Petitioner further submitted that the Petitioner is arrayed as Accused No.9. He is the salesman in the Fair Price shop. Originally, the Petitioner moved anticipatory bail before this Court. At that time, it was mentioned by the learned Additional Public Prosecutor that there is no case pending against the Petitioner. Therefore, the Anticipatory Bail Petition was dismissed. Subsequently, the order was recalled, on request of the learned Additional Public Prosecutor that he wrongly mentioned the Petitioner for some other accused. 2/4

Therefore, this Court after hearing the Petitioner granted anticipatory bail.

4.The learned Additional Public Prosecutor submitted that investigation had been completed and final report sent through online. However, due to technical defect in the Court concerned, it had not been taken on file.

5.In the light of the submission of the learned Additional Public Prosecutor, it is not a fit case for quashing the FIR. Hence, this Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
