PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the respondents 1 to 3 to reckon the period of remission as the sentence served by the petitioner's husband as more than 14

years and consequently to release the petitioner's husband namely (Paraman @ Paramasivam, S/o. Muniyaandi aged about 56 years) Life convict No. 0104, Madurai Central Prison, Madurai by premature release in accordance with G.O(Ms) No.64 dated 01.02.2018 as request as per the representation of the petitioner dated 31.07.2024 before this Court and set him at liberty forthwith under the provisions of Articles 14,20,21 of the Indian Constitution. The prayer in the Writ Petition is to direct the respondents 1 to 3 to reckon the period of remission as the sentence served by the petitioner's husband as more than 14 years and consequently to release the petitioner's husband namely (Paraman @ Paramasivam, S/o. Muniyaandi aged about 56 years) Life convict No. 0104, Madurai Central Prison, Madurai by premature release in accordance with G.O(Ms) No.64 dated 01.02.2018 as request as per the representation of the petitioner dated 31.07.2024 before this Court and set him at liberty forthwith under the provisions of Articles 14,20,21 of the Indian Constitution.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. Without expressing any opinion on merits of the writ petition, the respondents 1 to 3 are directed to consider the representation submitted by the petitioner, dated 31.07.2024 and pass orders on own merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, the writ petition (Crl.) stands disposed of. No costs.
