O R D E R
The Writ Petition is filed seeking a direction to the second respondent to pass appropriate orders on the application filed by the Petitioner on 15.2.2024 seeking deletion of the fourth respondent name from Patta NO.755 in respect of the property in S.No.56/2 situated at Vilpatti Village, Kodaikanal Taluk. 2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, the subject property was originally assigned in favour of Petitioner's grand mother Ayeesha Beevi and patta for the subject property stands in the name of Ayeesha Beevi. Later, the name of the fourth respondent was wrongly included in the patta along with Ayeesha Beevi in Patta No.755. Therefore the Petitioner submitted an application on 2/6
5.2.2023 seeking deletion of fourth respondent's name. Based on the said application, proceeding was initiated by the second respondent in Na.Ka.No.404/2023/Aa1. However, till date the same has not been concluded. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.
4.The learned counsel for the Petitioner submits that the correct date of application submitted by him is 15.02.2023.The said statement is recorded.
5.Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 to 3 would submit that proceedings initiated by the second respondent will be concluded within the time stipulated by this Court.
6.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to conclude the proceedings initiated by him in Na.Ka.No. 404/2023/Aa1 based on the application of the petitioner, dated 15.2.2023 and pass final orders on its own merits after affording reasonable opportunity to the Petitioner and fourth respondent, within a period of 12 weeks from the date of a copy of this order. 3/6
7.With the above directions, the Writ Petition stands disposed of. No costs.
