Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus directing the respondents 1 and 2 to produce the body of the petitioner's wife, the detenue namely Mrs. Divya Dev, wife of Deepathkumar, aged about 20 years before this Court and set her at liberty.

O R D E R

The Habeus Corpus Petition has been filed seeking production of the wife of the petitioner, since it was suspected that she was taken against her wishes by the third and fourth respondent to Calcutta.

2. When the matter came up for hearing on 19.09.2024, Mr. T.Senthil Kumar, learned Additional Public Prosecutor had taken notice on behalf of the respondents 1 and 2. He thereafter stated that efforts would be taken to secure the detenue.

3. Today the detenue had been produced before this Court. She stated that her parents has stated that there is a temple festive and had enticed her to go to Calcutta.

4. But, however we must place our deep appreciation for the strenuous efforts taken by Mr.Ashish Kumar, I.P.S., Superintendent of Police, Thanjavur District, Mr.Ravichandran, Deputy Superintendent of Police, Pattukottai, Mr. Nazeer, Inspector of Police (L&O), Pattukottai Police Station Mrs.Sasirekha, Sub Inspector of Police and Mrs. Sornalakshmi, Women Police Constable 977.

5. The Superintendent of Police, Thanjavur District had instructed the Inspector of Police, Pattukottai Police Station to monitor and send a special team consisting of the Special Sub Inspector of Police and women Police Constable to Calcutta to locate and bring back the detenue.. They have taken efforts and conducted enquiry and had brought back the detenue Divya Dev, wife of Deepathkumar, aged about 20 years before this Court.

6. We enquired the detenue and she stated that she would go back with her husband/the petitioner herein.

7. The custody has been handed over to the petitioner herein,but, however words of appreciation are required to be recorded for the efforts taken by the aforementioned officials .

8. No further orders are required to be passed in this petition, hence the Habeus Corpus Petition stands closed.
