This Habeas Corpus Petition had been filed by the father seeking protection of his daughter who was born on 10.09.1999, aged about 25 years as on date.
2. It had been complained that she might have gone with the third respondent. In the previous hearing date, it was informed that the daughter of the petitioner had appeared before Vadapalani Police Station in Chennai. We wanted an affidavit to be filed by the petitioner that he would not cause any harm either to his daughter or to the third respondent. An affidavit has been filed today and in which, paragraph No.4 had stated as follows:- "I respectfully state that I undertake by way of filing the affidavit that I and my family members
will not indulge any problem like law and order problem against the 3rd respondent and his family members. Furthermore, I and my family members will not act against my daughter's wishes. Further, I am ready to abide by any condition that may be imposed upon me."
3. In connection with the missing of the daughter, a complaint had been lodged and registered as FIR in Crime No.189 of 2024 as 'Missing Girl' by the second respondent/the Inspector of Police, Thiruchitrambalam Police Station at Thanjavur District. It is stated that the wife of the petitioner and the petitioner had gone over to B1 North Beach Police Station, Chennai on 20.09.2024 and the daughter had expressed willingness to come back with the wife of the petitioner.
4. Today, the petitioner is present and the daughter is also present before us. She expressed her wish to go along with her father.
5. Since the detenu had been produced and had been handed over to the petitioner herein, no further orders are required in the Habeas Corpus Petition and accordingly, this petition stands closed. [C.V.K., J.] [J.S.N.P., J.] 23.09.2024 NCC : Yes / No Internet : Yes / No PKN To:
