ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 417, 420, 468, 471 and 120B of 1/4
IPC in Crime No.23 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the de-facto complainant had paid about Rs.20,00,000/- on various dates ranging from 02.01.2022, 14.01.2022, 10.03.2023 to 13.05.2023 to the A-1/Petitioner in order to get clerk job in Indian National Army. The Accused no. 1/petitioner neither got any job for the de-facto complainant's son nor repaid the amount. The complaint was lodged before the Respondent police and enquiry was conducted. During the course of enquiry, the A-1/Petitioner agreed to repay the amount. However, he had never repaid the said amount. Hence, a case has been registered. 3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner. 5.Totally there are four accused. The learned counsel appearing for the 2/4
petitioner submitted said that the petitioner is also a victim and one Madhusoodana Rajan is the real accused. However, the learned Government Advocate (Crl.side) submitted that the petitioner also went along with the said Madhusoodana Rajan and along with some other person who has also paid money to secure job in the Indian Army.
6.The learned Counsel appearing for the intervenor submitted that he has given Rs.10,50,000/-. Some of the victims have also given house property and gold jewels.
7. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
8. Accordingly, this Criminal Original Petition is dismissed. 23.02.2026 Tmg 3/4
