Heard both sides.
2.The writ petitioner's brother filed O.S.No.3 of 2025 on the file of the Sub Court, Musiri seeking the relief of partition. The writ petitioner was shown as D4 in the suit. The matter was referred to Lok Adalat. On 08.03.2025, an award was passed recording a compromise between the parties. The petitioner wanted to register the said Lok Adalat award. But the second respondent declined to do so on the ground that in respect of Survey No.155/5, Mavilipatti Village the name of one Ganesan has already been entered.
3.A learned Judge of this Court vide order dated 17.12.2024 in W.P(MD)No.22114 of 2024 (T.Senthilvel Vs District Registration, 2/4
Administration & Others) had held that on the ground of double entry registration cannot be refused. This was followed by another learned single Judge dated 23.04.2025 in W.P(MD)No.11299 of 2025 (Amulraj Vs The Sub Registrar, Office of Sub Registrar, Sanarpatti, Dindigul District). The same approach can be adopted in this case also. In any event, patta stands in the name of the petitioner's family. 4.In this view of the matter, the impugned refusal check slip is quashed. The petitioner is permitted to re-present the document (Lok Adalat award dated 08.03.2025 in Case No.50 of 2025). The second respondent will receive the same and register it subject to the fulfilment of the other usual formalities.
5.This Writ Petition is allowed accordingly. No costs.
