ORDER

This Writ Petition is taken up for hearing at the time of admission with the consent of the learned counsel for the petitioner and learned Central Government Standing Counsel for the respondents.

2. This Writ Petition has been filed for a Mandamus to direct the respondent to issue fresh passport with the petitioner's date of birth is 05.02.1980 by considering his passport application reference No.25-1057585982, dated 26.07.2025.

3. It is noticed that the petitioner had two passport earlier which were issued on 22.03.1991 and 31.05.2000, which have since expired. In these passports, the date of birth of the petitioner has been wrongly entered as 20.10.1980.

4. It is submitted that the petitioner was a minor when these two passports were secured by the petitioner's father as per the prevailing practice then insofar issuance of the passports were concerned.

It is submitted that the the petitioner's actual date of birth is 05.02.1980 and therefore, the petitioner had applied for a fresh passport giving the correct date of birth as 05.02.1980 on 26.07.2025 vide passport application No. 25-1057585982. However, the respondent has not processed the passport application till date.

The learned Central Government Standing Counsel for the respondent submits that the petitioner may be directed to produce all the necessary documents, which the petitioner wishes to rely to establish the petitioner's actual date of birth as 05.02.1980. If the petitioner's produces such documents, the petitioner's passport application dated 26.07.2025 will be processed and disposed of.

Recording the above submissions, this Writ Petition is disposed of by directing the respondent to process the aforesaid passport application of the petitioner dated 26.07.2025 within a period of six (6) weeks from the date of receipt of a copy of this order, subject to the petitioner producing necessary documents to prove his date of birth as 05.02.1980. 3/5
