Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records of the second respondent in his proceedings in Na.Ka.C.V. 2/1221-4/2024, dated 26.10.2024 and quash the same as illegal, violation of law and further direct the respondents to appoint the Petitioner as a Salesmen, with all service benefits within the stipulated time. 1/5

ORDER

This writ petition has been filed seeking to quash the proceedings of the second respondent in Na.Ka.C.V.2/1221-4/2024, dated 26.10.2024 and further to direct the respondents to appoint the Petitioner as a Salesmen, with all service benefits within the stipulated time.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. The learned counsel appearing for the petitioner would submit that the petitioner was employed as a Salesman in the Tamil Nadu State Marketing Corporation Limited (TASMAC). Owing to certain allegations, he was placed under suspension, and till date, the suspension has not been revoked. Therefore, the grievance of the petitioner is that the disciplinary proceedings initiated against him have not been concluded, and hence, he prays for an appropriate direction to the second 2/5

respondent to conclude the disciplinary proceedings within a time frame fixed by this Court.

4. The learned Standing Counsel appearing for the respondents would submit that the disciplinary proceedings will be completed within the period that may be stipulated by this Court.

5. Considering the submissions made on either side, this Court is of the view that the disciplinary proceedings cannot be kept pending indefinitely. Accordingly, the writ petition stands disposed of with the following directions:

(i) The concerned respondent is directed to pay subsistence allowance to the petitioner, if not already paid, strictly in accordance with law. (ii) The respondents are directed to conclude the disciplinary proceedings initiated against the petitioner, within a period of four weeks from the date of receipt of a copy of this order. 3/5

No costs. Consequently, connected miscellaneous petition is closed.
