ORDER

(Order of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.

2. The petitioner herein filed W.P.(MD)No.7345 of 2024 for removal of the petition mentioned encroachment. This Court directed the jurisdictional BDO to pass an order on the petitioner's representation. The BDO rightly took up the matter with the jurisdictional Tahsildar. The jurisdictional Tahsildar has since passed eviction order under Section 6 of the Land Encroachment Act in October 2025 itself. In this contempt petition, the BDO alone has been shown as contemnor.

3. As rightly pointed out by the learned Additional Government Pleader, the BDO has done its job and therefore he cannot be hauled up for the lapse. However, we direct the Tahsildar, Ramanathapuram Taluk to take consequential action pursuant to the eviction order passed under Section 6 of the Land Encroachment Act. It goes without saying that if the encroacher files an appeal under Section 10 of the Act, the Tahsildar will have to be abide by the outcome of the appeal. If the order passed by him is not stayed or suspended, 2/4

the Tahsildar will have to necessarily proceed further in the matter. We expect the Tahsildar to conclude the aforesaid exercise within three months.

4. With the aforesaid direction to the Tahsildar, this Contempt Petition is closed.
