RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition as the petitioner shall appear before the 1st Additional District Judge, Madurai instead of the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders imposed upon the petitioner in Crl.O.P(MD)No.18480/2021 dated 25.11.2021 and pass such and thus render justice.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SATHISH KUMAR.K, Advocate for the petitioner and of MR.M.VAIKKAM KARUNANITHI, GOVERNMENT ADVOCATE (CRL.SIDE) on behalf of the Respondents the court made the following order:- This petition is filed seeking modification of the condition as 'the petitioner shall appear before the 1st Additional District Judge, Madurai' instead of 'the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders' imposed upon the petitioner in Crl.OP(MD)No.18480 of 2021, dated 25.11.2021. 2.The petitioner is facing charges under Sections 147, 148, 294 (b), 302 and 506(ii) of IPC and he was released on bail, by this Court, on 25.11.2021 with certain conditions and one of the condition is that the petitioner should appear before the respondent police daily at 10.30 a.m.

CRL MP(MD) No.11073 of 2021 3.The learned Government Advocate (Crl.Side) would submit that final report was filed before the 1st Additional District Judge, Madurai, and the same was taken on file in S.C.No.383 of 2020. Hence, the petitioner may appear before the concerned Trial Court. He would further submit that the petitioner is history sheeted rowdy.

4.This Court is of the considered view that only because of the antecedents of the petitioner, the above said condition is modified to the effect that the petitioner must appear before the Trial Court, daily at 10.30 a.m. In respect of other conditions shall remain unaltered.
