Respondent/Complainant For Petitioner : Mr.A.Robinson, Advocate For Respondent : Mr.S.Prakash, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.9 of 2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 498A, 448, 323 and 506(1) of IPC in Crime No.9 of 2024 on the file of the respondent police, seeks anticipatory bail. 1/6
2. The case of the prosecution is that the de-facto complainant married one Muruganantham and was residing with the 3rd accused, who is the mother-in-law of the de-facto complainant. It is alleged that the 3rd accused used to harass and threaten the de-facto complainant and her children with the intention of driving them out of the house, stating that the house belongs to the 1st accused, who is the elder brother of the de-facto complainant's husband. The petitioner/A2, who is the wife of the 1st accused, resides in Singapore along with her family and visits India once every year. Whenever they visit, they, along with the 3rd accused, used to threaten the de-facto complainant to vacate the house. Similarly, on 16.06.2024, at about 8.00 a.m.
, the 1st accused, along with his family, came to the house and demanded the de-facto complainant to leave the house with her family. Subsequently, on 24.06.2024, at about 8.00 a.m., when the villagers came to speak on behalf of the de-facto complainant, the 6th accused, along with A4, A5, and A7 who are the sisters-in-law of the de-facto complainant, assaulted the de-facto complainant's husband and attempted to tie him to a tamarind tree. When the defacto complainant tried to prevent the assault, the accused persons assaulted her as well. Hence, a case was registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the 2/6
prosecution, and that she has been falsely implicated in this case. He further submitted that A1, A3 to A7 were granted anticipatory bail by this Court on 02.07.2025 in Crl.O.P.(MD)No.11127 of 2025. He, however, submitted that the petitioner is willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.
4. The learned Government Advocate (Criminal Side) submitted that there are totally seven accused persons in this case and the petitioner has been arrayed as A2. A1, A3 to A7 were granted anticipatory bail by this Court on 02.07.2025 in Crl.O.P. (MD)No.11127 of 2025. He further submitted that the entire investigation in this case has been completed and a charge sheet has been filed in C.C.No.112 of 2025 on the file of the learned Judicial Magistrate, Orathanadu. However, he opposed to grant anticipatory bail to the petitioner.

Taking into consideration the facts and circumstances of the case, the nature of the offence, and taking note of the fact that the co-accused were granted anticipatory bail by this Court, and that the entire investigation has been completed in this case and a charge sheet has also been filed, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions.
6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance, within a period of fifteen days from the date on which 3/6
the order copy made ready, before the learned District Munsif cum Judicial Magistrate, Orathanadu, Thanjavur District, on condition that the petitioner shall execute a bond for a sum of Rs.
10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned District Munsif cum Judicial Magistrate, Orathanadu, Thanjavur District, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that: (a) the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioner shall furnish her residential address and mobile number to the learned District Munsif cum Judicial Magistrate, Orathanadu, Thanjavur District.
(c) the petitioner shall report before the learned District Munsif cum Judicial Magistrate, Orathanadu, Thanjavur District as and when required; (d) the petitioner shall not tamper with evidence or witness either during investigation or trial;

(e) the petitioner shall not abscond either during investigation or trial; (f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and; (g) if the accused/petitioner thereafter abscond, a fresh FIR can be registered under Section 269 of BNS, 2023.
