J U D G M E N T

The writ appeal had been filed by the first, second and third respondents in W.P. (MD) No.3764 of 2007 aggrieved by the direction of the learned Single Judge whereby, the writ petition was allowed and the order impugned in the writ petition, dated 06.03.2007 by which order, the fourth respondent in the writ petition, A.Rani was appointed as Cook had been set aside and it was directed to accept the recommendation made by the management of S.P.Rajendra Primary School, Mugilvanan Street, Rajapalayam, Virudhunagar District, to appoint K.Ramathilagam, as Noon-Meal Organizer. The fourth respondent in the writ petition, K.Rani, has not filed any writ appeal.

2.The writ petitioner, S.Kulanthaivelu, who was the Secretary, S.P.Rajendra Primary School, Virudhunagar District, has unfortunately died pending the writ appeal. However, the first, second

and third respondents in the writ petition had filed the writ appeal. 3.It is now informed by Mr.C.Godwin, the learned Counsel for S.P.Rajendra Primary School, Virudhunagar District, that the School has now only 11 students and therefore, there could be no possibility of a Noon-Meal Scheme Organizer being appointed in the said School. 4.In view of that particular issue, the issues raised in the writ petition have become otiose and the writ appeal also does not survive. The same stands disposed of. Consequently, the connected miscellaneous petition is closed. No costs.
