ORDER

This Writ Petition is taken up for hearing at the time of admission with the consent of the learned counsel for the petitioner and the learned Standing Counsel for the respondent.

2. This is the second round of litigation. Earlier, the petitioner had approached this Court in W.P.(MD) No.152 of 2024 for the following relief: " To direct the respondents 1 to 3 herein to allow the petitioner forthwith to join and work as Jewel Appraiser in the third respondent Bank on the basis of Verification Report issued by the Inspector of Police, Thiruppuvanam dated 24.07.2023 and by considering the representation given by the petitioner dated 16.10.2023 within the time stipulated by this Court."

However, the said Writ Petition was dismissed on 10.07.2024.

3. The present Writ Petition is filed for a Mandamus to direct the respondent to provide the petitioner with the Work Experience Certificate for the work done by the petitioner under the respondent Bank based upon the representation dated 21.04.2025.

4. It is noticed that the petitioner was empaneled as an Appraiser on 30.09.2013 by the respondent bank. However, the petitioner's services were dispensed with after he was de-empaneled on 21.05.2022.

5. Under these circumstances, the petitioner has now requested the respondent bank to provide Experience Certificate vide representations, dated 21.04.2025 and 29.04.2025, which has not evoked any response. Hence, the petitioner approached this Court for the abovesaid relief.

Arguing the case on behalf of the respondent, the learned Standing Counsel submits that since the petitioner was not a regular employee and therefore, the respondent bank is not obliged to issue the Work Experience Certificate. It is submitted that only a permanent employees for the reasons recorded therein are entitled to such Work Experience Certificate.

6. In any event, the learned Standing Counsel for the respondent submits that the petitioner's representations will be considered in the light of the prevailing Rules.

7. Recording the same, there shall be a direction to the respondent to consider the aforesaid representations dated 21.04.2025 and 29.04.2025 and dispose of the same.

8. In case there is no embargo under the existing Rules for issuing such certificate, such certificate shall be issued to the petitioner.

9. Entire exercise shall be completed within a period of six (6) weeks from the date of receipt of a copy of this order.
