ORDER

The Civil Revision Petition is filed against the fair and decreetal order dated 24.03.2025 passed in I.A.No.3/2024 in H.M.O.P.No. 234/2024 on the file of Family Court, Thoothukudi. 1/4

2. Since no adverse orders are going to be passed against the respondent, notice to the respondent is dispensed with.

3. The petitioner is the husband and the respondent is the wife. Their marriage was solemnized in the year 2013 and they were blessed with a male child. Due to matrimonial discard, the petitioner filed HMOP No.234/2024 for divorce. The respondent/wife filed Interlocutory application in the said HMOP claiming interim maintenance under Section 24 of the Hindu Marriage Act. The trial Court awarded Rs.7,000/- to the respondent wife towards interim maintenance per month. Challenging the same, the petitioner is before this Court.

4. The learned counsel for the petitioner would submit that the petitioner is working in an Oil Mill and earning only a sum of Rs.10,000/- and hence, the amount awarded by the trial Court is on the higher side.

5. I have considered the said submissions and perused the materials available on record.

A perusal of the typed set of papers and the order passed by the trial Court reveal that as against a claim of a sum of Rs.20,000/- towards interim maintenance, the trial Court, considering the case of the petitioner, has awarded a sum of Rs.7,000/- towards interim maintenance to the respondent and her child. The interim maintenance awarded is not stated to be on higher side. Considering the facts and circumstances of the case and considering the financial position of the petitioner and respondent, the trial Court has awarded the said interim maintenance, which is just and reasonable. Accordingly, the Civil Revision Petition is dismissed. No costs. Consequently connected Miscellaneous Petition is closed.
