PRAYER: Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorari and quash the order of the respondent passed in order in D.P.No.3/2019 dated 17.12.2019 as arbitrary and illegal. ORDER:- This Writ Petition is coming on for orders on this day under the Caption "Extension of Time for Lower Court" and upon perusing the report dated 08.02.2024 in D.No.757/2024/AW-1 by the Principal District Judge,Thanjavur, this Court made the following order:

[Order of the Court was made by D.KRISHNAKUMAR, J.] This matter is listed today under the caption "Extension of Time for Lower Court".

This Court, by order dated 05.12.2023, dismissed the above writ petition with a direction to the Principal District Judge, Thanjavur, to proceed with the matter based on the impugned charges, conclude the proceedings and pass final orders as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of the order.

The Principal District Judge, Thanjavur District, has filed report dated 08.02.2024, informing that the individual S.Jeyakumar was already removed from service on the forenoon of 01.03.2022 as per the order in another disciplinary proceedings in A.No.18/2020/AW-1 in D.P.No.06/2020 and hence, the the disciplinary proceedings in D.P.No.03/2019 in A.No.39/2019/AW-1 against which the present writ petition has been filed by him, was closed on 01.03.2022 itself as no further proceedings is necessary.

4. It is seen that the above factum was not brought to the notice of this Court on 05.12.2023, when the writ petition was dismissed.

Hence, in view of the above report of the Principal District Judge, Thanjavur, we are of the view that no further adjudication is required in this writ petition, even on the date of its dismissal i.e. 05.12.2023.
