RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed by this Honble Court that the petitioner shall appear before the Inspector of Police, CBCID, Sivagangai daily at 10.00 a.m in Crl.O.P.(MD).No.13744 of 2023 dated 31.07.2023 in Crime No.2/2023 on the file of the respondent police. Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.SUNDARAPANDIAN, Advocate for the petitioner and of Mr.R.M.ANBUNITHI, Additional Public Prosecutor(crl.side) on behalf of the Respondent, the Court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner in Crl.O.P(MD) No.13744 of 2023 dated 31.07.2023

2. According to the petitioner he has been complying with the condition from 31.07.2023 and due to the above said condition he is suffering a lot and he is not able to go for job for his avocation.

3. The learned Additional Public Prosecutor appearing for the respondent also admitted that the petitioner has been complying with the conditions from 31.07.2023 without fail as directed by this Court, however he objected to relax the condition on the ground that the investigation is still pending. 4.Considering the representation made by the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor and also considering the nature of offence and considering that the petitioner is complying with the condition without fail, this Court is inclined to modify the condition. Accordingly, the condition imposed on the petitioner is modified to the effect that the petitioner shall report before the respondent police @ 10.30 a.m., on the first day of every English Calendar month until further orders.
