O R D E R

This writ petition has been filed seeking for a direction to the 2nd respondent to renew the petitioner's Passport in Passport No.N3116435, by disposing the File No.MD1077524003325 pending on his file within the stipulated time.

2.Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents 1 and 2 as well as the learned Government Advocate (Criminal Side) appearing for the 3rd respondent.

3.It is notified that the petitioner has been arrayed as an accused in Crime No.590 of 2020, registered on 08/05/2020 for the offence under section 160 IPC.

4.The learned Government Advocate (Criminal side) confirmed that although FIR has been registered, no charge sheet has been filed and now the case is still under investigation.

5.Considering the same, there can be no impediment for processing the passport of the petitioner by the second respondent. Accordingly, there shall be a direction to the 2nd respondent to process the passport of the petitioner and issue the same within a period of six weeks from the date of receipt of a copy of this order. In case, after completing the investigation, charge sheet is filed by the third respondent before the concerned court and the same is taken on file, the petitioner shall voluntarily surrender the passport to the third respondent, failing which the third respondent is at liberty to take steps to seize the passport of the petitioner and hand over the same to the concerned court.

6.With the above direction, this writ petition stands disposed of. No costs.
