Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay the petitioner interest at the rate of 6% per annum, for the period of delay from 01.11.2022 to 31.05.2023, in paying the amounts paid towards the terminal benefits namely EPF Employees's Contribution, Gratuity and Encashment of leave of her deceased husband/ retired employee (late) T.S.Surendra Kumar, Staff No.7362, within a time frame as may be fixed by this Court.

O R D E R

The present Writ Petition has been filed by a wife of the deceased employee of the respondent Transport Corporation, who applied for voluntary retirement on 31.10.2022 seeking a Mandamus for payment of interest for the belated disbursement of pensionary benefits.

2. According to the learned counsel appearing for the petitioner, the petitioner's husband had passed away on 26.12.2023 and his terminal benefits were released only on 31.05.2023. Therefore, the petitioner has sent a representation on 15.07.2024 to the respondent seeking interest for the belated disbursement. Since there is no response, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent.

4. Considering the above said facts, the respondent is directed to pay interest at the rate of 6% per annum from the due date till the date of 2/4

disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
